Terms and Conditions

Preamble

These General Terms and Conditions of Sale ("T&Cs") govern all contractual relations between F&F Partners SAS, a French simplified joint-stock company (SAS) with share capital of [To be completed] €, registered with the Annecy Companies Register under number [Number], whose registered office is at [Address], Annecy (74000), France, trading under the brand name OWNYTE (hereinafter "OWNYTE"), and any adult individual making a booking (hereinafter "the Client").

Placing a booking constitutes full and unreserved acceptance of these T&Cs. OWNYTE reserves the right to amend these T&Cs at any time; the version in force at the date of booking shall apply.

1. Service Description

OWNYTE offers bespoke, all-inclusive premium nightlife experience packages, comprising:

  • A private pre-evening at the Client's home (champagne or signature cocktail, canapés)
  • Round-trip transport in a premium vehicle (high-end saloon or SUV)
  • A gastronomic dinner at a selected partner restaurant, with a personalised menu and wine pairings
  • Guaranteed VIP access to an after-party (private club, cocktail bar or lounge)
  • A dedicated OWNYTE concierge throughout the entire evening
  • Full personalisation of the experience based on stated preferences

The service is available for 1 to 3 guests, on Thursday, Friday, Saturday and Sunday evenings, within the Annecy — Geneva — Arve Valley / Chamonix geographic triangle. Bespoke quotes are available on request for groups of 4 to 6 guests.

2. Pricing and Payment

2.1 Price

The OWNYTE package is priced at €890 all-inclusive for 1 to 3 guests. This price is stated in euros and includes all applicable taxes. It covers all services described in Article 1.

2.2 Deposit and Balance

The booking is subject to payment of a 30% deposit of €267 at the time of confirmation. The remaining balance (€623) is due no later than 7 calendar days before the date of the evening. If the balance is not settled within this period, OWNYTE reserves the right to cancel the booking, with the deposit retained as a reservation fee pursuant to Article 5.1.

2.3 Instalment Payment

OWNYTE offers payment in up to 10 monthly instalments of €89, with no additional fees for the Client. All instalment processing fees are covered by OWNYTE. This service is operated via the Stripe secure payment platform.

2.4 Accepted Payment Methods

Credit/debit card (Visa, Mastercard, American Express), Apple Pay, Google Pay. All transactions are secured and processed by Stripe (PCI-DSS Level 1 certified). OWNYTE does not store any card data.

3. Contract Formation

The contract is formed upon the Client's booking confirmation and OWNYTE's receipt of the deposit. A confirmation email summarising the booking will be sent to the Client within 24 hours of receiving the deposit. This email constitutes definitive confirmation and grants access to a personal client account.

4. Right of Withdrawal

In accordance with Article L. 221-28, paragraph 12 of the French Consumer Code, the statutory 14-day right of withdrawal provided for under Article L. 221-18 does not apply to leisure services to be provided on a specific date or during a specific period.

As OWNYTE packages are nightlife experiences booked for a specific date, the Client expressly acknowledges, upon confirming their booking, that they waive their statutory right of withdrawal. The contractual cancellation conditions set out in Article 5 apply instead.

5. Cancellation, Rescheduling and Refunds

5.1 Cancellation by the Client

  • More than 48 hours before the evening: full refund of all amounts paid, with no penalty, within 14 working days.
  • Between 48 hours and 24 hours before the evening: 50% of the total price (€445) is retained as a cancellation fee; the balance is refunded within 14 working days.
  • Less than 24 hours before the evening or no-show: no refund. The full price is due and retained by OWNYTE.

All cancellation requests must be sent by email to contact@ownyte.fr. The date and time of receipt of the email shall constitute proof of cancellation.

5.2 Rescheduling

One date change per booking is granted free of charge, provided the request is made at least 72 hours before the original evening date, subject to OWNYTE availability.

5.3 Cancellation by OWNYTE

Should OWNYTE cancel (force majeure, exceptional event, or failure of a key independent partner beyond OWNYTE's control), the Client will be offered, at their discretion: a rescheduling to a later date at no extra charge, or a full refund of all amounts paid within 14 calendar days. OWNYTE shall not be liable for any indirect, immaterial or consequential loss beyond such refund.

6. Client Obligations and Conduct

The Client undertakes to provide accurate and complete information at the time of booking (dietary requirements, allergies, health constraints, preferences). OWNYTE cannot be held liable for consequences arising from inaccurate or incomplete information.

The Client is responsible for the conduct of all members of their group throughout the evening. OWNYTE reserves the right to terminate the service without refund in the event of inappropriate, disrespectful or dangerous behaviour by the Client or any member of their group.

7. Liability

OWNYTE endeavours to deploy all necessary means to ensure the quality and proper delivery of the described services. Its liability is limited to the total amount actually paid by the Client for the service concerned.

OWNYTE's partners (restaurants, venues, transport providers) are independent service providers. OWNYTE cannot be held responsible for their own failures, beyond providing an equivalent alternative or refunding the corresponding portion of the undelivered service.

OWNYTE shall not be liable for any indirect, immaterial or consequential loss resulting from partial or total non-performance of the service.

8. Personal Data

Personal data collected during the booking process is processed by F&F Partners SAS in accordance with the GDPR and its privacy policy set out in the website's Legal Notice. Data is used solely for the performance of the service, customer relationship management, and — subject to consent — for commercial communications. For any data-related request: contact@ownyte.fr.

9. Consumer Mediation

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably within one month of the Client's written complaint, the Client may refer the matter free of charge to a consumer mediator. OWNYTE is affiliated with CNPM — Consumer Mediation (cnpm-mediation-consommation.eu). The European Commission also provides an Online Dispute Resolution (ODR) platform at: ec.europa.eu/consumers/odr.

10. Governing Law and Jurisdiction

These T&Cs are governed by French law. In the event of a dispute, a consumer Client may bring proceedings before the court of their domicile or the court of the place of performance of the service. For disputes between businesses, the competent court is that of F&F Partners SAS's registered office, being the Annecy Commercial Court (Tribunal de Commerce d'Annecy).
